Terms of Service

These Terms of Service (“Terms”) govern your use of PRIVATE NOTARY, a cryptographic proof-of-existence service operated by EuronLab OÜ (“EuronLab”, “we”, “us” or “our”). By purchasing or using the service, you agree to these Terms.

1. The Service

PRIVATE NOTARY enables a user to create cryptographic evidence relating to the existence of a specific digital file at a particular point in time.

The original file is processed locally on the user’s device for the purpose of creating the cryptographic commitment. PRIVATE NOTARY is designed so that the original file does not need to be uploaded to or stored by EuronLab.

After successful processing and payment, cryptographic evidence is anchored to the Solana public blockchain and the user can obtain a proof package that can later be used together with the exact original file to verify the proof.

2. What the Proof Establishes

A successfully verified proof provides cryptographic evidence that the exact file corresponding to the proof existed no later than the time evidenced by the relevant blockchain record.

Verification also demonstrates that the file presented for verification is byte-for-byte consistent with the file for which that proof was created.

3. What the Proof Does Not Establish

PRIVATE NOTARY does not verify or certify:

  • the identity of the author or creator of a file;
  • ownership of a file or intellectual-property rights;
  • the truth, accuracy, legality or authenticity of the contents of a file;
  • the circumstances in which a file was created;
  • whether a person signed, approved or agreed to the contents of a file;
  • whether the file existed before the time evidenced by the proof; or
  • any fact other than what can be established from the cryptographic proof and the relevant blockchain record.

A PRIVATE NOTARY proof is not a notarisation performed by a public notary, a qualified trust service, a qualified electronic timestamp, an electronic signature, a governmental authority or a court. The name “PRIVATE NOTARY” is a product name and must not be interpreted as representing such status.

4. No Legal Advice or Guaranteed Evidentiary Effect

The service provides technical cryptographic evidence. We do not provide legal advice and do not guarantee that a PRIVATE NOTARY proof will be accepted as evidence by any particular court, authority, institution or third party.

The legal or evidentiary effect of a proof may depend on applicable law and the circumstances in which it is used.

5. Your Original File

You are responsible for retaining the exact original file. Verification requires the exact original file and the corresponding proof package.

If you lose or modify the original file, or lose the proof package, verification may become impossible. EuronLab does not undertake to store or recover your original file.

6. Proof Package

After successful creation of a proof, you are responsible for downloading and safely retaining the proof package provided by PRIVATE NOTARY.

The machine-readable .pnproof.json proof package contains information required to independently reconstruct and verify the proof. A human-readable PDF or other summary that may accompany it is provided for convenience only and is not a substitute for the machine-readable proof package.

7. Public Blockchain

PRIVATE NOTARY uses the Solana public blockchain to anchor cryptographic evidence. Confirmed public blockchain transactions are outside EuronLab’s exclusive control and are generally not capable of being modified or deleted by EuronLab.

EuronLab does not control the blockchain network and cannot guarantee its perpetual operation, availability, performance or future compatibility.

The original document is not intentionally written to the blockchain. Only cryptographic data necessary for the proof mechanism is anchored.

8. Multiple Proofs

The same file may be used to create more than one proof. Each successful proof creation uses fresh cryptographic data and may result in a separate cryptographic commitment, blockchain transaction and timestamp. Each such proof is independent and is charged separately.

9. Price and Payment

The price applicable to a proof is displayed before purchase. Unless otherwise stated, payment is a one-time payment for creation of one proof.

Payments are processed by a third-party payment provider. Taxes, where applicable, are handled in accordance with applicable law and the information presented at checkout.

10. Immediate Performance and Right of Withdrawal

PRIVATE NOTARY is designed to perform the purchased service immediately after payment.

Where required by applicable consumer law, before immediate performance begins you may be asked to expressly request that performance begin during the statutory withdrawal period and acknowledge that, once the service has been fully performed, you lose your right to withdraw from the contract.

Nothing in these Terms limits any mandatory consumer right that cannot lawfully be excluded.

11. Failed Proof Creation and Refunds

If payment succeeds but the proof cannot be successfully created because of a failure attributable to our service, we may retry the operation or provide an appropriate refund or other remedy.

This does not affect mandatory statutory remedies available to consumers.

12. User Responsibilities

You may use PRIVATE NOTARY only for lawful purposes. You are responsible for ensuring that you have the right to process the file and to create a proof relating to it.

You must not use the service in connection with unlawful activity or attempt to interfere with, abuse, disrupt or circumvent the service or its security mechanisms.

13. Intellectual Property

You retain whatever rights you hold in your original files. Using PRIVATE NOTARY does not transfer ownership of your file or its contents to EuronLab.

The PRIVATE NOTARY service, software, branding, website and associated materials remain the property of EuronLab or their respective licensors.

14. Availability and Changes

We may maintain, modify, improve or discontinue parts of the service. We do not guarantee uninterrupted availability of the website or of third-party infrastructure, including blockchain networks, internet infrastructure and payment services.

Discontinuation of the PRIVATE NOTARY website does not alter historical blockchain records that have already been successfully confirmed.

15. Limitation of Liability

To the maximum extent permitted by applicable law, EuronLab is not liable for indirect or consequential losses arising from use of the service, loss of a user’s original file or proof package, actions or failures of third-party infrastructure, or a third party’s refusal to recognise a proof.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer-protection rights.

16. Governing Law

These Terms are governed by the laws of Estonia, without prejudice to any mandatory consumer protections that apply to a consumer under the law of their country of residence.
